To consider the proposal to move to virtual Planning meetings. *

Cllr. Crawford reported that he and the Town Clerk had recently produced a paper regarding Governance, however, the situation has since changed. The Town Clerk advised that video conferencing in legislation prior to Saturday was actually unlawful owing to  the requirements of the Local Government Act 1972 which stated that councillors should be ‘summoned’ to meetings and physically be present in order for business to be transacted; there is also a requirement for the public to be able to attend. The new Coronavirus Act 2020 and Local Authorities and Police & Crime Panels Regulations allows multiple venues i.e. in people’s homes or elsewhere and electronic methods for debate are allowed under the Regulations and will remain in force until May 2021 when it will be reviewed.

The Committee considered the following planning applications.  It was RESOLVED that its recommendations would be submitted.

 

20/00142/AS

The Coach House, West Cross.

Change of use of existing garage to provide holiday let accommodation at first floor.

 

Cllr. Quinton commented that there is one objection to this application as there is no kitchen but this was not a material consideration. His only concern was whether this would be a fire hazard as this was a large garage with a floor above and the main house would still be using the garage under this flat.

 

Cllr. Crawford had looked at the Local Plan EMP4 which is the policy relating to this and could not see any issues.

 

SUPPORT but would like to request that the Planning Officer reviews the legalities and safety issues of the garage itself still being in use by the property owners for storage of their vehicles.

Cllr. Dr. Lovelidge commented that applications have been seen many times and it was refused to be taken from a holiday let to an unrestricted dwelling and now the application was for a change of use from a holiday let to an office. The reason why it was refused going to an unrestricted dwelling still holds. It is outside of the confines of any identified town or village and gives rise to unnecessary unsustainable development in the countryside which is detrimental to the environment.  The plot is right on a dangerous bend and you would be unable to see both ways very clearly. The consultant’s report advises that this would also cause a lot more traffic.

 

Cllr. Mrs. Walder expressed her concerns that this does not meet any sustainability tests.

 

OBJECT on the grounds that the application constitutes unsustainable development;  is detrimental to the environment;  there are concerns over the increase in traffic on a dangerous bend; and the development is outside the confines of any identified town or village.

(a)     Tenterden Golf Club.  The application for a premises licence for the sale of alcohol was NOTED.

 

(b)     Fibre to the Premises Supplementary Planning Document.  An invitation had been received to participate in the Fibre to the Premises Supplementary Planning Document consultation being held from 6th March 2020 to 1st May 2020.  Cllr. Knowles advised that this supports the ENP6 in Ashford’s Local Plan 2030.  Ashford Borough is the only Council that has this at the moment and every single planning application which fits the criteria that comes in, which in Tenterden is developments of 10 units or more or employment creation of 10 jobs or more, they are unable to get permission unless they can show that fibre to the premises is being installed.

 

A developer would need to show evidence in a Planning Statement that fibre to the premises is being designed into its final design. Tenterden was named by Openreach as a fibre to the premises exchange and BT have committed to it in a Press Statement.   It was agreed that Councillors would respond to the consultation individually.

(a)         Land North of 14 Westwell Court Planning Application.  Cllr. Sugden expressed his and residents’ concerns on the Westwell Court Care Home and Assisted living Houses Planning Application. Some of the Ecological surveys which were carried out in 2016/2017 were based on original developers plans and considerable alterations were made by them at a later date to the layout of the development and its buildings.  Only minor changes were made by the developers to these surveys to attempt to match the alterations. There has been no sign of the developer changing any of their surveys to match the building changes made and it is these that have caused considerable concern to the residents.

 

Cllr. Sugden reported that the residents are concerned that some documentation is not being placed on the portal by Ashford Borough Council such as resident’s letters, surveys and in particular an independent arboricultural “tree” survey which showed major discrepancies in the survey carried out by the developer. There is a  noticeable concern by some residents towards the Ashford Borough Council Planning department in the apparent preference given to the developers in placing documents onto the portal over those of residents.

 

Cllr. Sugden also reported the residents annoyance at the very short return date for comments on amendments sent out by Ashford Borough Council and the last two at the most inappropriate times where the Deputy Town Clerk has had to ask for an extension of time.  Cllr. Mrs. Walder advised that she has had a number of residents in contact with her in regard to this planning application. It was reported that the Deputy Town Clerk had approached the Planning Officer at Ashford Borough Council to request an extension to discuss this planning application at the next scheduled planning meeting on 6th May 2020 and was awaiting a response. 

 

Cllr. Mrs. Walder advised that she had written to the Deputy Town Clerk copying in the Tree Officer and the Planning Officer asking why the arboricultural report had not been put on the portal and asking why she claims that evidence supplied by Kent Wildlife Trust “cannot be supported on the portal” and was interested to find out her explanation as to why she is pre-seeking to prejudge expert evidence before it comes to the Planning Committee. Cllr. Mrs. Walder’s understanding is that comments do not go on the online portal if they are defamatory, racist or offensive and she struggled to understand how either of those documents could qualify for any of those categories.

 

Cllr. Clokie advised that going forward from now Ashford Borough Council will be conducting virtual planning committee meetings.  Cllr. Knowles advised that Ashford Borough Council have provision to hold Teams live meetings as from 26th April 2020.
